This was the year that Virginia's "triggerman rule" was supposed to be repealed. After three vetoes by Governor Tim Kaine undid lopsided votes in favor of removing the restriction on executing accomplices in murder cases, Governor McDonnell has made clear that he would sign this year's measure into law.
But on February 15, the Senate Courts of Justice Committee voted 9-6 to kill the bill, and it now appears unlikely that it can be revived this year. Among the voices against expanding Virginia's death penalty was Richmond Commonwealth's Attorney Michael Herring and former Virginia executioner Jerry Givens.
